Abstract

Policy Paper 132 | The Crimes of Incitement to Racism and Violenceiv the “religious exemption,” which wholly exempts religious publications from the category of incitement to racism . This interpretation does not necessarily follow from the language of the current law, but the court has refused to intervene in this policy . The fact that the Prosecutor’s Office has not published binding guidelines although there are internal guidelines ) creates additional uncertainty ( about its enforcement policy . We believe that the failure to publish its policy regarding incitement on social media creates uncertainty about the current law . It does not provide the public with guidance about what is permitted and what is prohibited, and, no less important – when the public may submit a complaint . In the comparative research section, we review the crimes of incitement in Great Britain, France, the United States, Canada, and international law .
