Abstract

Background and the Problems Facing Societies Dealing with Terrorism Societies dealing with terrorism have two main goals : ensuring their civilians ’ security , while also protecting human and civil rights . These two goals are sometimes in conflict , so that one cannot be maximally attained without making certain concessions in the other . Thus , when examining measures aimed at minimizing the threat of terror , it is important to weigh the benefits of deploying them against the damage they cause to rights . The best way to go about this is to employ proportionality tests : suitability , necessity , and proportionality in its narrowest sense , meaning that measures may be considered proportional when the expected benefits of their use exceed the harm they cause to rights or to other interests . A few rights – such as the right not to be exposed to torture – are protected absolutely .
