The Biblical Verse as a Source of Halakhah in Ramban’s Normative Jurisprudence

This paper argues that Ramban systematically appealed to his direct interpretation of the biblical verse in determining normative halakhah . I offer eleven examples where Ramban offers a novel, normative interpretation of Jewish law based on his reading of the biblical verse, unmediated by the Talmud . In some examples, Ramban’s conclusions have wide - reaching and dramatic practical implications . And Ramban endorses those conclusions even when the Talmud interprets the verses differently . This study suggests that the biblical verse was an active part of Ramban’s halakhic jurisprudence . For Ramban, the legal significance of the biblical text goes beyond the fact that it constitutes the basis for the Talmud’s application of the hermeneutical principles . Ramban saw the text of the Tanakh as an indispensable source of halakhic jurisprudence that continues to frame and inform the interpretation of Jewish law . II .
